What can I do to help my son?

Q- When my son is with his father during his visitation I would ask to speak to him his father gives him zero privacy and stands right next to him listening to our conversation causing my son not to be himself is there anything I can do and is that illegal? he is 13 years old. He also does this with the gaming Council he goes through his messages, as well as turning off showing online because me and my son play games when this feature is turned off it would show him offline when he is online so he is interfering with me playing games with him.
