I live in New York and my ex wife and 3 kids have lived in Florida for over 10 years. My oldest child just turned 21. ?

Q– The child support order was issued in New York but now that my oldest has turned 21 and I’m trying to modify the order the court is telling me they no longer have jurisdiction because it’s been longer than 10 years that the kids have lived in Florida . Please advise

A– If the NY Court cedes jurisdiction, that’s not necessarily a bad thing for you. Emancipation in NY is generally age 21 – while in Florida it’s generally 18. Thus, get a court order from NY saying NY no longer has jurisdiction, then then e-file your modification application in Florida. Call a Westchester Family Law attorney for more info.
