How can I subpoena the NYPD for financial records from a retired NYPD officer?

Q: I am currently in family court for child support. It’s been 2 1/2 years now and I haven’t received any money. The non custodial parent is in arrears for over 20k. He claims to be disabled and not receiving his pension or disability money from the NYPD in over a year since his retirement.

A: The subpoena would need to be “so-ordered” by the Magistrate. You would need to issue a copy of the proposed subpoena to the City of New York (copied to the father/his attorney), then submit the subpoena to the Magistrate. Bear in mind some Magistrate require this to be done on “order to show cause.” For a full assessment, schedule a consult with a Bronx Child Support Attorney.
