Q: The father and I have joint custody of my daughter but I make the final decisions. With his permission I moved to Connecticut from New York. While living in New York he barely seen his daughter since I’ve lived in Connecticut. I have brought her to New York a few times in months when I do attempt to bring her, he does not make time to see her . He currently pays child support every month however has not paid in over three months. He just filed stating that I moved with out his permission and has not seen her, I’m guessing he is stating that because he doesn’t want to pay child support. What should I do? (Were do I start)
A: Per he UCCJEA, once a court issues an order on custody/visitation, that issuing state retains continuing & exclusive jurisdiction over modification/enforcement cases. A minor exception – forum non conveniens, may apply. You’re best advised to schedule a consult with a Westchester Child Custody Attorney for a full assessment.
