Q– Almost a month ago our mother died unexpectedly, she was young and didn’t leave anything about who would take care of me and my sister. Luckily i am 18 but my little sister is 14. Our father is alive but we don’t speak and he lives in another state. He is very hard to deal with and we don’t have contact with him. We live with our grandma as before our mothers passing we all lived together. My grandma is in her 60s and capable of taking care of us but we are unsure is it’s possible. Would it be easier for me to gain guardianship or will we have to fight our father on it anyway?
A- It would be easier for the grandmother to petition for custody/guardianship. If your sister has been living with the grandmother for more than 2 years, you don’t need to prove the Father is unfit. Schedule a consult with a Bronx Custody Attorney for a full assessment.
